Charleston, W. Va., Wednesday, March 14, 2012The Senate met at 5 p.m.

(Senator Kessler, Mr. President, in the Chair.)

    Prayer was offered by Bishop Joe Thomas, Nondenominational Fellowship Pentecostal Ministries, Charleston, West Virginia.

    Pending the reading of the Journal of Tuesday, March 13, 2012,

    On motion of Senator D. Facemire, the Journal was approved and the further reading thereof dispensed with.

    At the request of Senator Unger, and by unanimous consent, the provisions of rule number fifty-four of the Rules of the Senate, relating to persons entitled to the privileges of the floor, were suspended in order to grant Bill Likens, Addie Likens, Larry Kessle, Connie Kessle and Letitia Neese Chafin, wife of the Honorable H. Truman Chafin, privileges of the floor for the day.

    The Senate proceeded to the fourth order of business.

    Senator Tucker, from the Joint Committee on Enrolled Bills, submitted the following report, which was received:

    Your Joint Committee on Enrolled Bills has examined, found truly enrolled, and on the 12th day of March, 2012, presented to His Excellency, the Governor, for his action, the following bills, signed by the President of the Senate and the Speaker of the House of Delegates:

    (Com. Sub. for H. B. No. 3177), Permitting an owner who sells real property pursuant to a deed of trust to terminate a preexisting tenancy.

    And,

    (H. B. No. 4251), Relating generally to amendments to the uniform commercial code.

    The Senate proceeded to the twelfth order of business.

    Remarks were made by Senators Chafin and Prezioso.

    Senator Unger then moved that the Senate adjourn until tomorrow, Thursday, March 15, 2012, at 11 a.m.

    The question being on the adoption of Senator Unger’s aforestated motion, and on this question, Senator Unger demanded the yeas and nays.

    The roll being taken, the yeas were: Boley, Browning, Chafin, Edgell, D. Facemire, K. Facemyer, Fanning, Foster, Green, Hall, Helmick, Jenkins, Kirkendoll, Laird, McCabe, Miller, Minard, Nohe, Palumbo, Plymale, Prezioso, Snyder, Stollings, Sypolt, Tucker, Unger, Williams, Wills, Yost and Kessler (Mr. President)--30.

    The nays were: Barnes, Beach, Klempa and Wells--4.

    Absent: None.

    So, a majority of those present and voting having voted in the affirmative, the President declared Senator Unger’s motion had prevailed.

    In accordance with the foregoing motion, the Senate adjourned until tomorrow, Thursday, March 15, 2012, at 11 a.m.
